Droit à un environnement propre, sain et durable en Afrique. Effets et défis
Aujourd’hui la grande partie de l’humanité a pris conscience de l’importance de l’environnement pour la survie de la vie humaine. Ainsi, depuis la déclaration de Stockholm en 1972, beaucoup d’initiatives à l’échelle internationale et régionale ont été entreprises, jusqu’à l’adoption de la résolution 48/13 de l’ONU en 2021, qui consacre le droit à un environnement sain, durable et sûr. Cet article explore les effets et les défis dudit droit en Afrique, aussi bien au niveau continental qu’au niveau régional, non sans avoir d’abord examiné le rapport entre l’environnement et les droits de l’homme. L’analyse révèle une interdépendance entre la protection de l’environnement et la jouissance des droits de l’homme. En Afrique, le droit à l’environnement est consigné dans beaucoup de documents normatifs, et a déjà produit ses effets comme l’attestent différentes affaires judiciaires. Toutefois, les défis aussi ne manquent pas, notamment la mauvaise foi politique et la pauvreté.

Abstract
Today, a great part of humanity is conscious of the impact of the environment on the survival of human life. Thus, since the Stockholm Declaration in 1972, many initiatives were undertaken, both at the international , which enshrines the right to a safe, clean, healthy, and sustainable environment. This article aims at exploring the effects and challenges of that right in Africa, both at continental and regional levels. Before that, however, it first focuses on the relationship between environmental protection and the enjoyment of human rights. The analysis shows that there is a strong interdependence between the two, and Africa has committed herself to the environmental cause, as attested by the normative instruments and legal cases defending the environment. However, there are also challenges, such as political bad faith and poverty, just to mention a few.
